What is At-Will Employment?

An employment arrangement where either the employer or employee can terminate the relationship at any time, for any legal reason, with or without notice.

At-Will Employment Explained

At-will employment means that the employment relationship can be ended by either party at any time and for any reason (as long as it is not illegal, such as discrimination). This is the default employment arrangement in most US states.

For employees, at-will employment means you can leave a job without legal obligation (though giving two weeks notice is professional courtesy). For employers, it means they can terminate employees without cause, though wrongful termination laws still apply.

Exceptions to at-will employment include union contracts, specific employment agreements, implied contracts, and public policy protections. If you have an employment contract, the terms of that contract supersede at-will provisions.

Example

Most US offer letters include: "This position is at-will employment, meaning either you or [Company] may terminate the employment relationship at any time, with or without cause or notice."

How This Relates to Your Resume

At-will employment affects how you leave jobs. Always give proper notice and leave on good terms — your former employers may be contacted as references for future opportunities.
